STATEMENT: CFCR WELCOMES MEETING BETWEEN CHIEF JUSTICE AND THE PRESIDENT

ZUMA CJThe Centre for Constitutional Rights (the CFCR) welcomes the recently concluded meeting between the Chief Justice as head of the Judiciary and the President as head of State. The meeting, at the request of the Chief Justice, Heads of Court and senior Judges of all Divisions, aimed to address the unwarranted attacks by some politicians on the Judiciary, but also the government’s apparent disregard for court orders.

The Centre for Constitutional Rights (CFCR) is a unit of the FW de Klerk Foundation – a nonprofit organisation dedicated to promoting and upholding the Constitution of the Republic of South Africa, 1996 (the Constitution). To this end, the CFCR seeks to promote the values, rights and principles provided for in the Constitution; to monitor developments including conduct, policy and draft legislation that might affect the Constitution and the values, rights or principles provided therein; to inform people and organisations of their constitutional rights; and to assist them in claiming their rights. Recently the Red Ant Security and Eviction Services, (the Red Ants) so called because of their red overalls and helmets, saw it prudent to evict dwellers from one such building, apparently at the behest of the building’s owner. ARTICLE: WOMEN – THE POWER IS OURS?

Womens DayIs South Africa ready for a woman president?” – screams the occasional news headline. The same question was posed to the president of the women’s league of the governing party, and elicited the following response: while there had been advances in having women in leadership, the “time was not yet ripe to have a woman lead” the party, and by implication, the country. The same question was asked a year later – the treasurer-general of the same organisation responded, “everybody is ready for a woman leader”.

STATEMENT: ATTACKS ON JUDICIARY UNACCEPTABLE

gavel smallThe Centre for Constitutional Rights (the CFCR) notes with great concern the increasing attacks on the independence, impartiality, dignity and effectiveness of the courts by senior members of the African National Congress (ANC) and its alliance partners.

ANC Secretary General, Gwede Mantashe, accuses the Judiciary of “overreaching” and “contradicting the interest of the state versus judiciary”. He reportedly stated that “there is a drive in sections of the judiciary to create chaos for governance… if it doesn’t happen in the Western Cape High Court, it will happen in the Northern Gauteng – those are the two benches where you always see that the narrative is totally negative and create a contradiction.
