The Centre for Constitutional Rights (CFCR) is pleased to announce the appointment of Ms Phephelaphi Dube as Legal Officer, as from January 2014.
The Centre for Constitutional Rights (CFCR) strongly condemns the violent and criminal behaviour by protestors resulting in shops and stalls of informal traders being looted and vandalised during a protest in Cape Town’s CBD today. The CFCR also condemns the reported incitement of criminal behaviour by African National Congress (ANC) councillor, Loyiso Nkhola, which allegedly led to today’s actions.
On 3 October 2013, the Constitutional Court upheld, in part, an appeal against a judgment of the Supreme Court of Appeal that is of core importance to South African education, school governing bodies (SGBs), as well as public single-medium schools.
The matter rested upon determination of the question of who has the final say in determining admission policy in South Africa’s public schools: schools and their SGBs or provincial departments of education?
The Centre for Constitutional Rights notes with much concern a statement by the Marikana Commission of Inquiry that the Commission has obtained documents which allegedly indicate that the South African Police Service (SAPS) may, “in material respects”, not have been truthful with the Commission.
Last week, the Constitutional Court handed down a judgment in which it dismissed an appeal from the Supreme Court of Appeal (SCA) in which the Constitutional Court ordered two Free State high schools to review their pupil pregnancy policies. The matter also – and very importantly – addressed the powers of a Head of a Provincial Department of Education (HOD) to issue instructions to the principals of public schools to act in contravention of school policies duly adopted by the governing body of such schools (SGB).
The Centre for Constitutional Rights (CFCR) welcomes and supports the Council for the Advancement of the South African Constitution’s (CASAC) and others’ call for the appointment of a qualified, fit and proper National Director of Public Prosecutions (NDPP). In this regard, we noted a decision by the Constitutional Court to reject CASAC’s application regarding the appointment of a permanent NDPP to be heard as an urgent matter and believe that the Court’s decision in no way reflects on the importance of the matter.
