FW DE KLERK FOUNDATION WELCOMES STRONGER OVERSIGHT UNDER NEW PSC ACT

The FW de Klerk Foundation welcomes the Public Service Commission Act 8 of 2026 as a positive step towards stronger independent oversight of public administration. The Act provides for an expanded mandate for the Public Service Commission (“PSC”) and a dedicated secretariat to support its work. Its success must be measured by better administration and services for South Africans.

This is consistent with the Foundation’s support for merit-based appointments and professionalisation of the public sector. Section 195 of the Constitution requires ethical, accountable administration and employment practices based on ability, objectivity, fairness and redress to achieve broad representation. Implementation must uphold these principles and protect the PSC from political interference.

The wider mandate covers municipalities and public entities, subject to commencement and phased implementation. This matters to people facing repeated service failures: independent scrutiny can expose staffing and management weaknesses behind those failures. Responsibility for restoring services remains with the institution concerned.

Once section 13 is in force, recipients of PSC decisions must normally report within 60 days on how those decisions were implemented or otherwise dealt with, unless the PSC determines or allows another period. This reporting requirement is distinct from the deadline for implementing a direction. Findings must lead to lawful corrective action.

Signing the Act does not bring it into operation. Commencement remains pending on the published information available as at 23 September 2026. Section 23 requires a presidential proclamation in the Government Gazette and allows different commencement dates. Section 22 delays implementation of the municipal and public-entity mandate for 12 months from commencement, followed by a progressive rollout over no more than three years, subject to resources.

The Foundation calls on government and the PSC to publish a clear implementation plan with cost estimates, adequate provision for skilled staff and a timetable for the rollout. Parliament should monitor readiness and follow up when institutions fail to respond. The public should see evidence that investigations result in corrected practices and improved performance.

South Africans deserve public institutions that act fairly, accept responsibility and deliver services.

Effective implementation will require adequate resources, protection from political interference and clear evidence that PSC findings lead to meaningful corrective action.
