2. The CFCR welcomes the opportunity to make concise submissions to the Committee on the aforementioned Bill in response to your call for submission as published on www.parliament.gov.za .
3. It is not the purpose or intention of this submission to provide comprehensive legal analysis or technical assessment of the Bill, but rather to draw attention to key concerns in relation to the Bill, particularly in so far as it relates to constitutional values, rights and requirements.
4. The CFCR is, in principle, concerned about the application of the right to equality as provided for in section 9 of the Constitution – especially pertaining to the notion of demographic representation. We are also concerned about certain technical and practical implications which the Bill will create, including the cumulative effect which the Bill may have on job creation and related economic impact.
