With reference to your call for submissions as published on www.parliament.gov.za, the CFCR welcomes the opportunity to make concise submissions to the Committee regarding the Legal Practice Bill [20B-2012] and certain aspects of the Bill that we believe require revision or amendment.
The CFCR made concise written submissions to the Portfolio Committee on Justice and Constitutional Development during its public hearing process. It is hence not the purpose or intention of this submission to provide a comprehensive legal analysis of the Bill and all matters related thereto, but rather to draw attention to those aspects and clauses which could likely have a negative impact on the independence of the legal profession – and by implication, on the constitutionally-required independence of the judiciary and the Rule of Law itself.
