d. On June 20, Christine Nxumalo received an SMS notifying her that her 50-year old sister, Virginia Machpelah, was in the process of being transferred from Life Esidimeni to a facility run by an NGO in Cullinan outside of Pretoria. On August 25, Nxumalo received a phone call from Precious Angels in Atteridgeville, informing her that her sister had passed away. This came as complete shock to Machpelah, as she thought her sister had been transferred to Cullinan. It was later discovered that Nxumalo had in fact died 9 days prior, on August 17–the death is still unknown.
e. In terms of section 184 of the Constitution, among the primary objectives of the SAHRC are “to promote respect for human rights and a culture of human rights” and to “monitor and assess the observance of human rights in the Republic”;
f. Section 9(1) of the Constitution states that everyone is equal before the law and has the right to equal protection and benefit of the law. Section 9(2) and 9(3) adds that equality includes the full and equal enjoyment of all rights and freedoms and that the state may not unfairly discriminate directly or indirectly against anyone on one or more grounds, including disability.
