Last year, in a landmark judgment for South Africa, the Constitutional Court declared the South African Electoral Act to be unconstitutional. More specifically, the court ruled that the current wording thereof limits the rights of ordinary citizens not to affiliate themselves with a political party if they want to be elected for public office. The court ruled that individual candidates must be allowed to contest elections independently – in a manner that is “free from the rigorous constraints of political parties”.
