Die beslissing sal verseker dat die “wil van die mense” nie deur korrupsie ondermyn word nie, wat dikwels moontlik gemaak word deur private finansiering wat nie openbaar gemaak word nie. Dit laat ook min ruimte vir noue sektariese belange om te floreer. Die aanvaarding van die\u00a0Political Party Funding Bill<\/em>\u00a0(B33 – 2017) is in ‘n gevorderde stadium voor die Parlement. Hierdie Wetsontwerp, toegepas met die gewysigde PAIA, sal uiteindelik private politieke finansiering hervorm, wat Suid-Afrika se demokrasie sal verbeter en verdiep.<\/p>\n

Die FW de Klerk Stigting verwelkom die Konsitusionele Hof se beslissing in My Vote Counts NPC v Minister of Justice and Correctional Services and Another<\/em>. Die beslissing, wat ‘n vroe\u00ebre beslissing van die Wes-Kaapse Ho\u00eb Hof bevestig, stel dit duidelik dat die onbeheerse finansiering van politieke partye of individue wat verkiesbaar is vir ‘n politieke amp, geen plek het binne ‘n grondwetlike demokrasie wat gegrond is op die waardes van deursigtigheid en verantwoordbaarheid nie. <\/p>\n

Die beslissing versterk die kiesers se reg om ingeligte politieke besluite te neem deur te vereis dat die inligting betreffende die private finansiering van politieke partye en onafhanklike kandidate aangeteken, bewaar en redelikerwys beskikbaar moet wees. Die bepalings van die Promotion of Access to Information Act<\/em> 2 of 2000 (PAIA), wat politieke partye en onafhanklike kandidate uitsluit, is ook ongeldig verklaar. Die ongeldigheidsbevel is wel vir 18 maande opgeskort ten einde die Parlement in staat te stel om PAIA reg te stel en dit in ooreenstemming met die beslissing te bring. Dit beteken dat dit hoogs waarskynlik is dat politieke partye in die nasionale en provinsiale verkiesings van 2019 deur ‘n gewysigde PAIA bestuur sal word.
